Welcome to AMA Remedies. The terms “we,” “us,” and “our” refer to AMA Remedies, a handcrafted herbal-remedy business owned and operated by Adrian & Melissa Golarte in Laredo, Texas. We operate this website and store, including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping and educational experience (the “Services”). Our online store is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced within them (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as health and herbal-product disclaimers, warranty disclaimers, and limitations of liability.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our privacy practices (Section 11). If you do not agree to these Terms, you should not use or access our Services.
By agreeing to these Terms of Service, you represent that you are at least 18 years of age, or the age of majority in your state or province of residence, and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services — including browsing our store or purchasing any product or service — you may be asked to provide certain information, such as your name, email address, and billing, payment, and shipping details. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.
If checkout creates an account for you, you are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.
Our products are handcrafted herbal preparations sold for general wellness and educational purposes only. They are not drugs or medicines. The statements made about our products and on our Services have not been evaluated by the U.S. Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease or health condition.
Nothing on the Services — including product descriptions, the herb collection, blog or educational content, testimonials, or any communication from us — is medical advice, and none of it is a substitute for professional medical care. Traditional or historical uses of an herb are shared for educational interest only and are not a claim that any product will produce a particular result for you.
Herbal products may not be appropriate for everyone. Some herbs can cause allergic reactions, may interact with medications, or may be unsafe during pregnancy or nursing or for certain medical conditions. You should consult a qualified healthcare provider before using any herbal product, especially if you are pregnant, nursing, taking medication, have a medical condition, or are giving a product to a child. Review the full ingredients of each product and discontinue use and seek medical attention if you experience an adverse reaction.
You are solely responsible for evaluating whether a product is suitable for you, and you use our products at your own risk. By purchasing or using our products, you acknowledge and agree to this disclaimer.
We make every effort to represent our products accurately. However, colors and product appearance may differ from how they appear on your screen because of your device, its settings, and the natural variation of botanical ingredients. Because our products are made from whole plants in small batches, minor variations in color, scent, texture, and appearance between batches are normal and are not defects.
All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and to limit the quantities of any products we offer to any person, geographic region, or jurisdiction on a case-by-case basis.
Custom & made-to-order blends: we craft custom mixtures, tinctures, and herbal tea blends on request. Because these are prepared specifically for you, custom or made-to-order blends are final sale and non-refundable, as described in our Returns Policy.
When you place an order, you are making an offer to purchase. AMA Remedies reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted.
If we do not accept, make a change to, or cancel an order, we will attempt to notify you using the email, billing address, and/or phone number you provided at the time of the order. Your purchases are subject to return or exchange solely in accordance with our Returns Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Prices, discounts, and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation. Unless expressly stated otherwise, posted prices do not include taxes, shipping, or handling. From time to time we may offer promotions that are governed by their own terms; if there is a conflict between a promotion’s terms and these Terms, the promotion’s terms govern.
You agree to provide current, complete, and accurate purchase and payment information for all purchases, and to promptly update your account information as needed so we can complete your transactions and contact you. You represent and warrant that (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use the payment method; and (iii) you will pay all charges you incur at the posted prices, including shipping, handling, and all applicable taxes. Payments are processed securely through Shopify and its payment providers; we do not store your full card number.
Shipping timeframes, processing times, and delivery details are described in our Shipping & Returns policy, which is incorporated into these Terms. All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, weather, or other events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you.
Returns and refunds are handled solely in accordance with our Returns Policy. In general, we accept returns of unopened, unused products within 30 days of purchase for refund or exchange, and custom or made-to-order blends are non-refundable. If your order arrives damaged or is not what you ordered, please keep the package and contact us so we can make it right.
Our Services — including all trademarks, brand elements, text, displays, images, graphics, product photography, reviews, video, and audio, and the design, selection, and arrangement of them — are owned by AMA Remedies, its affiliates, or its licensors and are protected by U.S. and foreign copyright, trademark, and other intellectual-property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material on the Services without our prior written consent. Unauthorized use may violate federal and state law. All rights not expressly granted are reserved.
“AMA Remedies” and our logos, product names, designs, and slogans are trademarks of AMA Remedies. You must not use them without our prior written permission. Shopify’s name, logo, and marks are trademarks of Shopify. All other names and marks appearing on the Services are the property of their respective owners.
The Services may contain links to, and may make available, materials, websites, and tools provided or operated by third parties (including embedded third-party functionality and the educational resources we link to). We do not monitor, control, or endorse these third-party materials and provide access to any optional tools “as is” and “as available” without warranties of any kind.
We are not responsible for examining or evaluating the content or accuracy of any third-party materials, and we are not liable for any harm related to your use of third-party websites, tools, products, or services. Any use of a third party’s materials or tools is entirely at your own risk, and you should review that third party’s terms and policies. Complaints regarding third-party products or services should be directed to the third party.
Our store is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with AMA Remedies. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and AMA Remedies, including any injury, damage, or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with AMA Remedies.
We respect your privacy and collect only the information we need to run our business — for example, the name, email address, phone number, and shipping and payment details you provide when you contact us or place an order. We use this information to process and deliver your orders, respond to your inquiries, and improve our Services. We do not sell your personal information. Because our store is hosted by Shopify, information you submit at checkout is transmitted to and processed by Shopify (and its payment and fulfillment partners) in order to complete your transaction, and may be processed in countries other than where you reside. Shopify’s handling of that information is governed by Shopify’s Consumer Privacy Policy. By using the Services, you acknowledge these practices. These SMS & Text Message Program Terms are the terms of service for the AMA Remedies mobile messaging program (the “Messaging Program”), operated by Ama Remedies, LLC. They apply in addition to the rest of these Terms and specifically govern our SMS and RCS text-messaging service.
Program & consent. By opting in you agree to receive recurring automated promotional and personalized marketing text messages from Ama Remedies, LLC at the number provided. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. Consent is not a condition of purchase.
How to opt in. You may join the Messaging Program by submitting your mobile number through our website sign-up forms, at our farmer’s-market table, or by texting our published keyword to our messaging number. By opting in, you confirm that the mobile number provided is yours.
Message types. Messages may include promotions, sales and new-product announcements, cart reminders, back-in-stock alerts, order updates, subscription notices, and billing-related messages.
How to opt out. You can cancel at any time by replying STOP to any message. After you send STOP, we will send you one confirmation message and then stop sending messages. For help, reply HELP, email us at Orders@AMARemedies.com, or call 956-951-4242.
Carriers & delivery. Wireless carriers are not liable for delayed or undelivered messages. Message and data rates may apply to messages you send to us and messages we send to you.
Your privacy. We handle your mobile information in accordance with our Privacy Policy. We do not sell your personal information, and we do not share mobile opt-in information or consent with third parties for their own marketing purposes.
If you submit any ideas, suggestions, feedback, reviews, or other content (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback in any medium for any purpose, including commercial use, such as to operate, evaluate, improve, and promote the Services. We are under no obligation to keep Feedback confidential, to pay for it, or to respond to it.
You represent and warrant that you own or have all necessary rights to your Feedback, that you have disclosed any compensation or incentive you received in connection with it, and that it complies with these Terms. Your Feedback must not be false, misleading, unlawful, defamatory, obscene, or infringing, must not impersonate another person, and must not contain any virus or malware. You are solely responsible for your Feedback and its accuracy. We may, but are not obligated to, monitor, edit, or remove Feedback we determine in our sole discretion to be objectionable or in violation of these Terms.
Occasionally information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time and without prior notice (including after you have submitted your order).
You may access and use the Services for lawful purposes only. You agree not to use the Services, directly or indirectly:
We reserve the right to suspend, disable, or terminate your access at any time, without notice, if we determine that you have violated any part of these Terms.
We may terminate this agreement or your access to the Services (or any part of them) in our sole discretion at any time and without notice, and you will remain liable for all amounts due up to and including the date of termination. The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.
The information presented on or through the Services is made available for general information purposes only. We do not warrant the accuracy, completeness, or usefulness of this information, and any reliance you place on it is strictly at your own risk.

WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AMA REMEDIES, OR ITS OWNERS, PARTNERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS (OR THOSE OF SHOPIFY AND ITS AFFILIATES), BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND — INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST DATA, OR REPLACEMENT COSTS — WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PROCURED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless AMA Remedies, Shopify, and our respective affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, arising out of (1) your breach of these Terms or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
These Terms of Service, and any separate agreements by which we provide you Services, are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that the exclusive venue and jurisdiction for any dispute arising out of or relating to these Terms or the Services shall be the state and federal courts located in Webb County, Laredo, Texas, and you consent to personal jurisdiction in those courts.
These Terms are drafted and maintained in English. Any translation of these Terms into another language is provided for your convenience only. In the event of any conflict or inconsistency between the English version and a translated version, the English version controls.
You can review the most current version of these Terms of Service at any time on this page. We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically. Changes are effective on the date they are posted (shown as the “Last updated” date above), and your continued use of the Services after changes are posted constitutes acceptance of those changes.
Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity of the remaining provisions.
Waiver & Entire Agreement. Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision. These Terms, together with any policies posted on our site, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements. Any ambiguities are not to be construed against the drafting party.
Assignment. You may not assign or transfer these Terms or your rights or obligations under them without our prior written consent, and any such attempt is void. We may assign or transfer these Terms and our rights and obligations without your consent or notice. Headings are for convenience only and do not affect the interpretation of these Terms.
